Terms & Conditions

General Terms and Conditions – Haus Hubertus Boltenhagen

1) Scope
1.1 These General Terms and Conditions (hereinafter “GTC”) of Haus Hubertus (hereinafter “Provider”) apply to contracts concluded between a consumer or business (hereinafter “Guest”) and the Provider for the rental of vacation apartments. The guest’s own terms and conditions are hereby rejected unless otherwise agreed in writing.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
1.3 In addition to the rental agreement, these General Terms and Conditions and the house rules form part of the rental agreement. By concluding the rental agreement, the guest accepts them.

2) Conclusion of Contract and Terms of Payment
2.1 The online presentation of the vacation apartments does not constitute a binding offer by the provider to conclude a rental agreement, but serves as an invitation to the guest to submit a binding offer.
2.2 The guest can submit the offer using the reservation form integrated into the provider’s website. After completing the electronic reservation process, the guest submits a legally binding contractual offer for the selected vacation apartment by clicking the reservation button.
2.3 The provider can accept the guest's offer within five days,
– by sending the guest a reservation confirmation in writing (via email), in which case the guest’s receipt of the reservation confirmation is decisive. If the provider does not accept the guest’s offer within the aforementioned time limit, this shall be deemed a rejection of the offer, with the result that the guest is no longer bound by his or her declaration of intent.
2.4 The contracting parties are the provider and the guest, as well as the persons accompanying the guest. If a third party has made the booking on behalf of the guest, that third party is jointly and severally liable with the guest to the provider for all obligations arising from the contract. An unauthorized overnight guest who is not part of the booking will be charged twice the basic nightly rate.

3) Cancellation
3.1 Without triggering payment claims from the provider, the guest is entitled to cancel up to 90 days before arrival, otherwise in accordance with the following conditions:

Cancellation no later than
89–60 days
59–30 days
29 days or fewer
Share of the accommodation price payable
30 percent
50 percent
100 percent

3.2 If the rental is ended early or the guest does not arrive, the guest is not entitled to a refund for the unused rental days. In good faith, the provider will try to re-let the unused apartment where possible to avoid losses. The guest then no longer has a right to occupy the property. Until the apartment is re-let, the guest must pay the calculated amount for the duration of the contract.
3.3 We recommend taking out travel cancellation insurance to cover any costs that may arise.

4) Arrival and Departure, Key Handover; Late Departure
4.1 The day of arrival counts as a rental day and is charged as such. A nightly rate is agreed. On the day of arrival, the booked vacation apartment is available to the guest from 2 p.m. The guest is not entitled to earlier access. Arrival must take place by 6 p.m., unless a later arrival time has been expressly agreed with the provider in advance. The spa tax must be paid in cash on arrival. On departure, the apartment is inspected by a member of the Haus Hubertus staff.
4.2 On the day of departure, the guest must vacate the vacation apartment by 10 a.m. If the vacation apartment is vacated late, the provider is entitled to an additional payment from the guest. This amounts to a) €50.00 (net) if the apartment is vacated after 10 a.m. but before 12 noon; b) 100% of the agreed nightly rate if it is vacated after 12 noon. In addition, the provider is entitled to compensation for any further damage resulting from the late departure. The guest is free to prove to the provider that no damage or significantly less damage has been incurred.

5) Rights and Obligations
5.1 The provider hands over the vacation apartment in a proper and clean condition with a complete inventory. Any defects that exist or arise during the rental period must be reported to the provider immediately (at the latest within 2 days). After this period, any resulting claims against the provider can no longer be asserted. Defects are generally remedied immediately.
5.2 The guest is liable for any damage they cause to the vacation apartment, its inventory and the shared facilities, e.g. broken dishes or damage to the floor or furniture. This also includes the costs of lost keys (locking system).
5.3 The guest must comply with the house rules. Quiet hours apply from 10 p.m. to 7 a.m. During this time, particular consideration must be shown to other guests and neighbors. TV and audio devices must be kept at a moderate volume.
5.4 Pets of any kind may only be accommodated in the vacation apartment with the provider’s prior written consent. The provider may charge a reasonable surcharge for accommodating animals. If animals (other than dogs) are accommodated without the provider’s prior consent, the provider may charge a cleaning fee of up to €200.00 (net).
5.5 Smoking is prohibited throughout the vacation apartment. In the event of violations, the provider may charge a cleaning fee of up to €200.00 (net). Smoking is only permitted on balconies and terraces.
5.6 The provider has the right to access the vacation apartment at any time, especially in the event of imminent danger. When exercising this right, the provider will give due consideration to the guest’s legitimate interests and will inform the guest in advance, unless this is unreasonable or impossible in the circumstances of the individual case.

6) Withdrawal by the Provider
If the provider cancels due to force majeure or other unforeseeable circumstances beyond its control that make performance impossible, liability is limited to the refund of the costs. In the event of a justified withdrawal, the guest is not entitled to compensation – no liability is accepted for travel or hotel costs.

7) Liability and Limitation Period
7.1 The provider is liable for exercising the care of a prudent businessperson. Outside the scope of its typical services, however, this liability is limited to deficiencies in performance, damage, consequential damage or disruptions caused by intent or gross negligence. If disruptions or defects occur in the provider’s services, the provider will endeavor to remedy them as soon as it becomes aware of them or upon the guest’s prompt complaint.
7.2 The provider is not liable for items brought in by the guest; they are not deemed items brought in within the meaning of Sections 701 et seq. of the German Civil Code (BGB). Any liability of the provider under these provisions is therefore expressly excluded. This also expressly applies to valuables that the guest keeps and/or leaves in the vacation apartment.
7.3 The guest is liable for all damage that they, their fellow travelers or their visitors culpably cause in the building, in the vacation apartment and/or to its inventory. We recommend that guests take out private liability insurance. The guest must report any damage to the provider immediately. This applies in particular to damage that may also affect other apartments in the building (e.g. water or fire damage).
7.4 The guest’s claims become time-barred after six months unless the provider is liable for intent. The provider’s claims become time-barred within the respective statutory period.

8) Spa Tax
In accordance with the ‘Statute of the Municipality of Ostseebad Boltenhagen on the Levying of Spa Taxes’, a spa tax is payable.
